Agreement to Terms

By accessing or using Webclerk's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

Description of Service

Webclerk provides AI-powered chatbot services for businesses. We create, configure, and maintain chatbots that can answer questions based on your provided content and website information.

AI Processing: To generate chatbot responses, we process your knowledge-base content and conversation messages via Google Cloud's Vertex AI platform (the Gemini model), using its EU endpoint, which acts as our subprocessor. Under Google Cloud's data-processing terms, this data is not used to train Google's models. See our Privacy Policy for details.

User Responsibilities

• Provide accurate information about your business
• Ensure you have rights to any content you upload
• Use the service in compliance with applicable laws
• Not attempt to reverse engineer or misuse our technology
• Maintain the security of your account credentials

Acceptable Use

You agree not to:

• Use the service for illegal or unauthorized purposes
• Upload harmful, offensive, or inappropriate content
• Interfere with or disrupt the service
• Violate any applicable laws or regulations
• Impersonate another person or entity

Facebook Messenger Channel

Businesses may connect their own Facebook Page so their chatbot answers Messenger messages sent to that Page. By connecting a Page, you confirm that you administer that Page and agree to comply with Meta's Platform Terms and Messenger Platform policies.

The chatbot sends an automated-chat disclosure at the start of Messenger conversations. You are responsible for keeping that disclosure accurate.

You remain the data controller for your Messenger conversations, as described in our Privacy Policy.

Intellectual Property

You retain ownership of your content. By using our service, you grant us a license to use and process your content — including by the AI subprocessor described above — solely to provide the service.

Our technology, software, and service remain our intellectual property.

Payment Terms

• Fees are billed according to your agreed plan
• We may change pricing with reasonable notice
• Refund questions can be directed to admin@webclerk.io

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted service. We may temporarily suspend service for maintenance or updates.

Limitation of Liability

To the fullest extent permitted by law, Webclerk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our service.

Termination

We may terminate or suspend your account and access to our service at our sole discretion, with or without notice, for violation of these terms.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any changes by posting the updated terms on this page.
